Rules and regulations for the use of services in a cosmetology salon

§ 1
General provisions

1 These Regulations, hereinafter referred to as the "Regulations", set out the rules for using the services provided at the cosmetology salon HOLISTIC Karolina Prus, hereinafter referred to as the "Salon".
(2) Clients of the Salon are required to read the Terms and Conditions before undertaking any treatment, hereinafter referred to as a "Treatment".
(3) Joining the Treatment is tantamount to accepting the provisions of the Regulations. Each Client is obliged to comply directly with its provisions from the moment of joining the Treatment.
(4) These regulations are not regulations for the provision of services by electronic means within the meaning of the Act on the Provision of Electronic Services and apply only to services provided in stationary outlets.

§ 2
Customers

1 The customer of the Salon may be an adult natural person.
(2) It is permissible for minors over the age of 13 to receive Treatments with the express consent of their parent, guardian or legal representative. An employee of the Salon is entitled to request at any time the relevant consent or to establish a connection with the person entitled to consent in order to confirm the consent, and to refuse to provide the Treatment in the absence of consent or refusal to give consent.

§ 3
Hygiene and safety

(1) Flat surfaces and other items of Salon equipment with which the Client does not come into direct contact during the Treatment shall be disinfected or sterilised at least once a day.
(2) Only disinfectants approved for use in a beauty salon shall be used in the Salon.

§ 4
Provision of services

Before starting the Treatment, the Worker carries out an interview with the Client to establish whether the Client's state of health, past or present illnesses, as well as lifestyle, constitute contraindications to the Treatment or do not pose a risk of side effects, and to establish post-treatment recommendations. The Client is fully aware of and accepts them when entering the Treatment. A staff member has the right to refuse to carry out a Treatment in the absence of the Client's willingness to make such a declaration.
(2) By proceeding with the treatment, the Customer declares that:
- He or she is familiar with the purpose and possible effects of performing the procedure,
- All issues related to the preparation and application of the chosen treatment were explained to him, which he fully understood.
- He knows and understands all contraindications, possible side effects and the effects of the procedure.
- He has been informed about the characteristics of the selected treatments and is aware that the treatments in question do not guarantee certain and visible results.
- It will not claim reimbursement for the treatment in the event that the chosen treatment does not achieve the intended result.
- He has taken his health condition into account before proceeding with the procedure and will not proceed with the procedure if, due to his health condition, the procedure could adversely affect his life, health, physical or mental comfort.
- Not pregnant, postpartum or lactating, taking medication, using any other substances or having a medical condition that is a contraindication to the treatment.
- He made an informed decision about his choice of treatment, taking into account his current state of health.
- He or she agrees to modify the way the procedure is performed or even to abandon the procedure if continuing it according to the prescribed procedure will endanger his or her life or health.

3 Clients, prior to the start of the Treatment, are obliged to inform the Employee of any ailments, diseases and contraindications that may affect the course of the Treatment.
4 Whenever a Treatment is not carried out in a series where the interval between consecutive Treatments is a maximum of 7 days or before the start of the next series that follows a period of more than 14 days, the Client should confirm the validity of the interview and the information provided.
(5) An employee has the right to refuse to carry out a Treatment if he/she considers that there are contraindications to carrying out the Treatment, if he/she finds that the Client is under the influence of alcohol or intoxicants.
(6) The customer shall be financially responsible for any damage caused on the premises of the Salon through his/her fault. Their legal representatives are responsible for damages caused by minors.

(7) In the event of a client's inappropriate behaviour at Holistic or a gross violation of the order or process of the Treatment, the staff shall have the right to refuse or interrupt the service and ask the client to leave the Salon immediately. In such a situation, Holistic shall have the right to immediately terminate the service contract and retain the service fee in full as compensation for losses incurred and compensation for lost benefits.

§ 5
Rules for the use of treatment packages

1. Packages can be purchased at the Salon for some of the treatments on offer.
(2) The Package is the property of the person who has purchased it and only he or she may carry out the treatments within the Package.
3. each Package has a specific expiry date and this date must be adhered to. 4 Holistic reserves the right to refuse any treatment after the expiry date of the Package.
5.Holistic does not accept returns of Packages, does not refund the cost of treatments not provided, and does not exchange Packages for cash or any other treatments.
6 The purchased Package can be used only for the body part that the Beneficiary specifies when purchasing the Package and the treatments from the Package cannot be used for other body parts.
(7) The client using the Package is obliged to inform the client of any changes between treatments that may affect the safety and effectiveness of the treatment (emerging contraindications).
(8) An employee has the right to refuse a treatment if he or she considers that there is any contraindication to it.
(9) Holistic reserves the right to treat a treatment as completed without the possibility of a refund if it considers that the client using the Package has booked the appointment with knowledge of a contraindication or has not cancelled the treatment for other reasons 24 hours before the treatment. The client, at any time, may take advantage of a free telephone or personal consultation to verify any contraindications.
BODY TREATMENT PACKAGES
1 We offer packages of 10 and 15 body modelling treatments (Endermology).
3 When purchasing the first package of any kind, the Beneficiary will receive an Endermowear outfit free of charge.
4 The packages are valid for: 10 treatments 6 months, 15 treatments for 1 year.
5. other packages are valid for 6 months.

§ 6
Payment

(1) The Client is obliged to pay for the services provided. The price list of Treatments is available in the Salon and online on Holistic Karolina Prus' profile on Instagram and Facebook.
(2) The following payment methods are available in the Lounge: payment in cash, payment by credit card, payment by bank transfer and by blister.
(3) The Salon reserves the right to conduct temporary promotions for treatments provided at the Salon. Taking advantage of the reduced price or promotional offer may be subject to separate rules which will be made public. Clients who have paid the full price of a Treatment shall not be entitled to any claims on account of the promotion.
4 Passes are also available at the Salon, payable in advance, entitling you to a certain number of Treatments over a certain period of time.
5 Vouchers are available in the Lounge, which are issued for a specific period of time, for a specific person and unused ones are automatically cancelled at the end of their validity.
6 Services/Packages/Vouchers/Vouchers purchased from Holistic are non-refundable and non-exchangeable for cash.

§ 7
Responsibility

(1) The Salon shall be responsible for the outer garments entrusted for safekeeping, provided there is a separate place in the Salon to leave them, or other items if they have been expressly accepted for safekeeping. The Salon shall not, however, be responsible for any items left in the Salon outside the places designated for leaving them, in particular valuables, bags, rucksacks and handbags which the Customer should keep with him/her.
3 The Salon shall be liable for the improper performance of the Treatment by the Employees.
(4) Failure by the client to comply with the provisions of the Rules and Regulations or making false statements regarding his/her state of health and contraindications or in an interview will result in a disclaimer on the part of the salon.
(5) The Salon shall not be responsible for the Client's dissatisfaction with the final result of the Treatment, resulting from the Client's subjective feelings, if it was performed professionally, in accordance with the art and in a manner that does not fall short of generally accepted standards.
6 The salon is not responsible for complications after the treatment or for the lack of the desired effects of the treatment in the event of non-compliance with post-treatment recommendations and home care.
(7) The information provided by Salon staff is for informational and educational purposes only and cannot replace the advice and recommendations of a medical practitioner. By using the Salon's offer, the Client is aware, acknowledges and agrees that the Salon does not offer medical consultations or advice.

§ 8
Reservations

(1) The client can pre-arrange a date for the Treatment at the Salon, by telephone, through the Booksy portal or by e-mail.
2 By making a booking you accept these terms and conditions.
(3) In order to cancel an appointment, the Salon Reception must be contacted by telephone, by sms email or via the Booksy portal at least 24 hours before the treatment date. In this case, the client will not be charged for the cancellation.
Failure to cancel a visit by the client at least 24 hours before the scheduled treatment will be tantamount to considering the visit as completed without the possibility to apply for a refund. The treatment purchased as a package will be considered as performed.
5 You must turn up on time for your booked Treatment. The Salon retains the right not to perform a Treatment for a Client who arrives more than 15 minutes late.
(6) Notwithstanding the foregoing, with the express consent of the Client, the Treatment may be performed even though it is late, provided that the individual stages of the Treatment shall be shortened at the discretion of the Worker, except for stages which have a specific minimum duration. The Treatment so performed shall be charged at full price.
7 If the Treatment is delayed for reasons attributable to the Salon, including the Employee, none of the stages will be shortened.
8 The Salon reserves the right to cancel an appointment in exceptional circumstances 24 hours before the appointment. The Salon will simultaneously agree a new date for the Treatment with the Client.

§ 9
Complaints

(1) The Client has the right to make a complaint about the way in which the Treatment was performed or its effects, within 7 days of the performance of the Treatment or the occurrence of undesired effects of the Treatment. In order to make a claim, it is necessary to prove the performance of the Treatment at the Salon in any form.
(2) Complaints shall be submitted in writing in person at the Salon or by registered mail sent to the address of the Salon. It is advisable to enclose photo documentation with the claim.
3 Complaints will be acknowledged within 30 days.
(4) If the complaint is accepted, the Salon will refund the price of the Treatment to the Client or allow the Client to benefit from a corrective Treatment free of charge. The Salon may offer additional benefits as compensation.
(5) In the event of refusal of a complaint, the Customer shall have the right to appeal against this decision within 14 days. In the appeal procedure the above provisions shall apply accordingly.
(6) In the event that the Treatment is disputed immediately after it has been performed, the Client is not relieved of payment for the service provided - in the event that his/her claims are legitimate, any refund will be made in full. However, the Salon reserves the right to exempt the Client from payment in case of obviously justified grounds for complaint.

§ 10
Other provisions
(1) Smoking and the use of tobacco and nicotine products, including electronic cigarettes, are strictly prohibited throughout the Salon, as is the consumption of alcoholic beverages and other stimulants and intoxicants.
(2) It is forbidden to bring animals into the Salon.

§ 11
Final provisions

(1) Every Customer has the right to inspect the regulations, price list and certificates referred to by the Salon or the Employees.
(2) The Salon reserves the right to amend the regulations. The new provisions are binding from the moment they are published in the Salon. The previous provisions shall apply to bookings and Treatments performed before the change.
(3) Any disputes arising from the provision of cosmetic services should, in the first instance, be resolved amicably.
(4) Matters not covered by the regulations shall be governed by the relevant provisions of the Civil Code.

These regulations are effective from 1 August 2023.
